Welcome to March81 Photography (“Company,” “we,” “us,” or “our”)! By accessing or using our website (www.march81photo.com) and services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our services.

1. Services Provided

March81 Photography specializes in wedding, boudoir, and portrait photography. Our services include, but are not limited to, consultations, photography sessions, editing, and the delivery of digital galleries and physical products.

2. Booking and Payments

• A signed contract and retainer fee are required to secure your session or event date.
• Retainer fees and monies paid are non-refundable but are transferable to a new date within 12 months, subject to our availability.
• Final payments are due as outlined in your photography agreement. Failure to pay on time may result in cancellation of your session or event.

3. Cancellations and Rescheduling

• Cancellation requests must be submitted in writing.
• If you need to reschedule your session or event, please notify us as soon as possible. Rescheduling is subject to our availability and may require additional fees.

4. Gallery Delivery

We use Pic-Time to deliver digital galleries. By using the gallery service, you agree to Pic-Time’s Terms of Service, which can be found at https://www.pic-time.com/#TermsOfService. March81 Photography is not responsible for any issues related to the use of the Pic-Time platform, including but not limited to technical errors or storage limitations.

5. Copyright and Usage

• March81 Photography retains copyright ownership of all images created during your session or event.
• Clients receive a personal usage license to print and share images for non-commercial purposes.
• Any modifications, editing, or commercial use of the images requires prior written consent from March81 Photography.

6. Liability

• While we strive to provide exceptional service, we are not liable for unforeseen circumstances, including but not limited to weather, illness, or equipment failure.
• In the unlikely event that we are unable to deliver services due to circumstances beyond our control, our liability is limited to a refund of amounts paid.

7. Client Responsibilities

• Clients must provide accurate information and cooperate fully during the planning and execution of photography sessions.
• Clients are responsible for securing necessary permissions and permits for the selected photography location(s).

8. Privacy and Data Security

• We value your privacy and will take reasonable measures to protect your personal information. For details, please refer to our Privacy Policy.
• Pic-Time’s data handling policies apply to the use of their gallery platform.

9. Amendments to These Terms

March81 Photography reserves the right to update or modify these Terms at any time. Changes will be posted on our website with the effective date. Continued use of our services constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.
